These conditions are applicable to all sales concluded with the hotel Les Coutainvillaises, 9 Rue Amiral Tourville in Agon Coutainville, France (50230).
As such, the customer acknowledges having read these general conditions of sale and undertakes to respect them.
These conditions of sale may be modified at any time, and the applicable conditions will be those in force on the date the reservation is made.

ARTICLE 1 – RATES

The rates indicated are in €uro including all taxes and take into account the VAT applicable on the day of the reservation.

Any change in the applicable rate, or any modification or introduction of new legal taxes introduced by the competent authorities, will be automatically passed on to the prices indicated on the date of invoicing.

Rates are per room for the number of people indicated and according to the period selected and do not include services (unless otherwise stated).

The tourist tax of 0.50€ per day and per person (over 18 year-olds) is not included in the price shown and must be paid directly on the spot. It applies all year round.

Certain services may be subject to a supplement and to possible modifications without prior notice, and the hotel cannot be held responsible for them.

No stay booked before the implementation of a possible promotional offer will be refunded, even partially.

ARTICLE 2 – RESERVATIONS AND MEANS OF PAYMENT

Reservations can be made on the website www.lescoutainvillaises.fr, by telephone, email or post.

The reservation will be effective only if the latter is guaranteed by the customer, either by communicating a credit card number with validity date or by payment of a deposit, and after receipt of a detailed booking confirmation.

Payment for all services will be made directly to the hotel (exceptions made for prepaid reservations at the time of booking).

The hotel reserves the right to refuse any reservation if the credit card number is incorrect or the reservation is incomplete.

Reservations regardless of origin are payable in €uro only.

The hotel Les Coutainvillaises accepts the following credit cards: Visa and Mastercard and has a secure reservation system (SSL) which protects and encrypts all sensitive data transmitted at the time of booking in order to prevent any disclosure to a third party.

When the booking is registered, authorisation to debit the credit card will be given. This will be done for information purposes only, and will in no way be a debit to the account except in the following cases:
– “Non-cancellable/non-refundable” promotional offer.
– If the validity date of the credit card is prior to the date of arrival.
– If the date of arrival is more than 89 days from the date of booking.

The customer is solely responsible for his or her choice of services and their suitability to his or her needs, so that Hotel Les Coutainvillaises cannot be held liable in this respect.

ARTICLE 3 – FORCE MAJEURE

Force majeure is understood to mean any event external to the parties that is both unforeseeable and insurmountable and that prevents the client, in the execution of the trip, from fulfilling all or part of the obligations provided for in the contract. This will be the case in particular in the event of strikes by means of transport, hotel staff, government or public demonstrations.

ARTICLE 4 – MODIFICATION AND CANCELLATION OF STAY

Any modification or cancellation of a reservation must be requested by email reservation@lescoutainvillaises.fr or by telephone at +33 (0)2 33 47 05 77.

The request will only become effective once the Hotel Les Coutainvillaises has confirmed its acceptance in writing.

In case of modification or cancellation of the stay, the following conditions apply (except in case of force majeure):

From 01 January to 04 April, from 13 to 23 May, from 03 June to 04 July and from 02 September to 31 December, in case of cancellation up to 2 days before the date of arrival, the hotel does not charge any fee. If cancelled or modified less than 2 days before the date of arrival, 100 percent of the first night will be charged.

If cancelled up to 30 days before the date of arrival, no fee will be charged from 05 April until 12 May, from 24 May until 2 June and from 05 July until 01 September. If cancelled or modified less than 30 days before the date of arrival, a deposit of 30 percent of the total amount will be charged.

If cancelled after 7:00 PM on the day of arrival, the first night will be charged and a deposit of 30% of the remaining amount will be charged.

In case of no-show, the hotel will charge 100 percent of the stay and is entitled to re-let the room.

In the event of interruption, the nights and services spent will be invoiced and the deposit corresponding to 30% of the value of the rest of the stay will be invoiced and will not be deducted from the invoice.

ARTICLE 5 – THE HOTEL AND SERVICES

For reasons of safety and hygiene, animals are not allowed in the establishment.

Rooms are available from 4:00 PM and must be vacated by 11:00 AM on the day of departure. A supplement may be charged if the maximum departure time is not respected. In case of arrival after 7:00 PM, reception must be notified.

The client accepts and undertakes to use the room decently. Furthermore, any behaviour contrary to good morals and public order will lead the hotel staff to ask the customer to leave the establishment without any compensation and or without any refund if a payment has already been made.

ARTICLE 6 – DISLODGEMENT

In the event of non-availability of the Hotel Les Coutainvillaises or in the event of force majeure, the latter reserves the right to have the customer stay totally or partially in a hotel of equivalent or superior category, offering services of similar nature.

ARTICLE 7 – CLAIMS

Any complaint must be sent to Hotel Les Coutainvillaises by registered letter with acknowledgment of receipt, within 15 days of departure. After this period, no claim can be taken into account.

ARTICLE 8 – INFORMATION TECHNOLOGY AND FREEDOM

In application of the French law 78-17, known as the “Informatique et Libertés” law (Data Protection Act), customers are informed that their reservation is subject to computerized personal data processing. Users have the right to access and rectify the data entered, which can be exercised by contacting the head office: SARL Les Coutainvillaises 9, Rue Amiral Tourville 50230 AGON COUTAINVILLE, FRANCE. It is specified that this information is not communicated to third parties.

The hotel Les Coutainvillaises offers WiFi internet access. The client user undertakes to ensure that the computer resources made available to him or her are in no way used for the purposes of reproduction, representation, dissemination or communication to the public of works or objects protected by copyright, by a related right such as texts, images, photographs, audiovisual musical works, software and video games, without the authorisation of the holders of the rights provided for in Books I and II of the French Intellectual Property Code when such authorisation is required.

ARTICLE 9 – LIABILITY

The hotel Les Coutainvillaises declines all responsibility in the event of theft, loss or damage to the belongings of guests during their stay.

The client will be held responsible for any damage, deterioration or vandalism that may occur as a result of the occupation of the premises and/or the participants and/or the staff for whom they are responsible, both to movable, decorative and immovable property belonging or not belonging to the hotel. The Hotel Les Coutainvillaises may therefore ask the client to leave the establishment without any compensation or reimbursement for the current stay, and to reimburse any damage caused by these acts.

All rooms are non-smoking. The Hotel Les Coutainvillaises reserves the right to charge customers who smoke in their room the equivalent of one night’s accommodation for additional cleaning costs. If the guest wishes to continue smoking inside or outside the indicated areas, he or she will be asked to leave the hotel.

ARTICLE 10 – APPLICABLE LAW

These General Terms and Conditions of Sale are governed by French law. This is the case for the rules of substance as well as for the rules of form. Disputes shall fall within the exclusive jurisdiction of the French courts.
